Terms of Service

1. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction, if higher) to create an account. By creating an account, you represent that you meet this requirement and that the information you provide during registration is accurate.

2. Your Account

You're responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at the contact below if you believe your account has been compromised. You may not create an account on behalf of someone else without their permission, or maintain more than one account for deceptive or abusive purposes.

3. Community Standards and Acceptable Use

Boundless is a community for athletes to connect, train together, and compete. There is zero tolerance for objectionable content or abusive users. When using the Service, you agree not to:

• Post slurs, hate speech, or attacks on anyone for their race, ethnicity, religion, gender, sexual orientation, disability, or any other part of who they are
• Harass, bully, threaten, or intimidate other members, or keep messaging someone who doesn't want to hear from you, in posts, comments, chats, direct messages, or anywhere else in the Service
• Post sexual content, graphic violence, or content that encourages self-harm
• Post content that is illegal, defamatory, or infringes someone else's intellectual property or privacy rights
• Impersonate another person, coach, or organization, or misrepresent your affiliation with any person or organization
• Send spam, unsolicited advertising, scams, or malware, or try to trick people out of money or personal information
• Attempt to access another member's account, or any part of the Service you're not authorized to access
• Scrape, harvest, or otherwise collect other members' information for purposes outside the Service
• Interfere with or disrupt the Service's operation, including its servers or networks, or get around its security checks, content filters, or blocks

Reporting and blocking. You can report any post, comment, message, workout, or profile, and block any member, from within the app. Blocked members can't message you, and neither of you sees the other's content. Our team reviews every report within 24 hours.

Enforcement. We may remove content that violates these Terms, and suspend or permanently terminate the accounts of members who post it, at our discretion and with or without notice.

4. Your Content

You retain ownership of the posts, comments, messages, photos, routes, and other content you submit to the Service ("Your Content"). By submitting Your Content, you grant Boundless a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display Your Content solely for the purpose of operating and providing the Service to you and other members (for example, showing your forum post to other members of a group you've joined). This license ends when you delete the specific content or delete your account, except where a copy has reasonably persisted in routine backups, which we will purge in the ordinary course, or where a copy of reported content is kept for moderation records.

You're solely responsible for Your Content and for having the rights necessary to post it. Text is automatically checked for slurs and hateful language before it's published, and we review content that members report, but we don't review everything posted and aren't responsible for content posted by other members. We may remove content that violates these Terms or applicable law.

5. Events, Competitions, and Physical Activity

The Service lets members organize and join group workouts, training groups, events, and leaderboard competitions involving physical activity such as running, cycling, and multisport training. Participation in any activity organized or discovered through the Service (whether a casual group workout or a listed race) is entirely at your own risk. Boundless does not organize, supervise, or guarantee the safety of any event or workout listed or discussed on the Service, even if it's featured or listed by us; the Service is a platform connecting athletes, not an event organizer or insurer. Races and events listed in the Service are run by their own organizers under their own rules. Consult a physician before beginning any new training program, use appropriate judgment and safety equipment, and follow the rules and requirements of any race or event you register for.

6. Third-Party Services and Links

The Service optionally integrates with TrainingPeaks, if you choose to link your account, and relies on third-party services such as Apple's Maps and push notification services, OpenStreetMap, and Cloudflare's security checks. Posts and messages may contain links to, and previews of, third-party websites. Your use of third-party services and websites is subject to their own terms and privacy policies, which we don't control, and we're not responsible for their availability, accuracy, or content.

7. Intellectual Property

The Service, including its design, branding, logos, and underlying software (but excluding Your Content), is owned by Theo Holdings LLC and protected by intellectual property laws. Race names and marks belong to their respective owners. You may not copy, modify, distribute, or create derivative works from the Service except as necessary to use it as intended.

8. Termination

You may stop using the Service at any time, and may permanently delete your account and associated data at any time from Profile → Delete Account. This takes effect immediately and can't be undone. We may suspend or terminate your access to the Service at our discretion, including for violation of these Terms, with notice where reasonably practicable.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or secure, or that content posted by other members is accurate or reliable.

10. Limitation of Liability

To the fullest extent permitted by law, Theo Holdings LLC and its officers, employees, and agents won't be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service, including any injury sustained during a workout, event, or activity organized or discovered through the Service, even if we've been advised of the possibility of such damages. Our total liability for any claim arising from these Terms or the Service is limited to the amount you've paid us in the twelve months before the claim arose, or $100 if you haven't paid us anything.

11. Indemnification

You agree to indemnify and hold Theo Holdings LLC harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, Your Content, or your violation of these Terms.

12. Apple App Store Terms

If you downloaded the app from Apple's App Store, the following also applies:

• These Terms are between you and Theo Holdings LLC only, not Apple. Theo Holdings LLC, not Apple, is solely responsible for the app and its content.
• Your use of the app must also comply with the App Store Terms of Service, including its Usage Rules.
• Apple has no obligation to provide maintenance or support for the app.
• To the maximum extent permitted by law, Apple has no warranty obligation with respect to the app. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) paid for the app.
• Theo Holdings LLC, not Apple, is responsible for addressing any claims relating to the app or your use of it, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and consumer protection claims, and for the investigation, defense, and settlement of any claim that the app infringes a third party's intellectual property rights.
• You represent that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the app or by email before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. The "Effective date" above reflects the most recent revision.

14. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws principles, except where applicable consumer-protection law in your jurisdiction requires otherwise.
